Katulad ng dulang mabilis ang takbo ng kasaysayan ay kinakailangan kong umagapay sa biglaang pagbabago ng pacing sa istorya sapagkat sa bawat pagpapalit ng tagpo ay kasing kahulugan ng madaliang pagsasara ng telon.
Bagama’t labis ang dalamhati ng may akda sa pagyao ni Chairman Noli “Bunso” Magsambol Jr. na isang mabuting kaibigan ay labis naman ang alalahanin ko sa pagkakaratay sa pagamutan dahil sa maselang na karamdaman ng kapatid ko sa binyag na si Chairman Boyeth “Kuya” Dioso. Na-stroke si Boyeth at bawat sandali ay nagdudulot ng sobrang pangamba.
Tapos na ang pitak na ito noon pang araw ng Miyerkules at ang buod ay may kasamang taimtim na panalangin ukol sa maaga niyang paggaling. Ang kailangan na lamang ay ang isumite ito sa palimbagan upang maging bahagi ng blogspot na ito.
Subalit kagya’t ng bawat tagpo sa dula ng buhay dahil sa habang naghihintay ng paglabas ng bakanteng oras upang ma-i-post ito ay isang nakakagimbal na balita ang gumalantang sa kasapian ng Liga ng mga Barangay Huwebes, habang lumulubog ang Haring Araw ay tuluyang pumanaw si Boyeth na tila hindi na kinayanan ang labis na hirap na dinaranas ng kanyang katawang lupa.
Hindi dapat magwakas ang kolum na ito sa puntong naghihirap ang isang itinuturing kong higit pa sa kapatid, sabihin mang ang nais ko’y makita siyang lagpas sa panganib. Sa pagkakataong ito’y hindi nanaig ang nais ko, manapa’y ang loob ng Poong Maykapal.
Katulad ni yumaong Noli “Bunso” Magsambol Jr. ay niloob ni Bathalang makapiling na si Kuya Boyeth Dioso sa Kanyang kaharian. Marahil ay higit sila Niyang kailangan. Nais ko mang tumutol ay wala nang magagawa sapagkat ang Panginoon na ang nangusap. San Pablo City - Umaani na ng suporta ang Todo Unlad: Malamig Festival 2009 buhat sa mga samahang sibiko at mga personaheng nagtitiwala sa mga residente ng naturang Barangay San Jose (Malamig) na sustainable ang nasimulang pag-unlad ng nasabing lugar.
Nabatid sa KANAYON, ang komitibang nagsusulong sa pestibal, na mula ng sumang-ayon si San Jose Barangay Chairman and ABC President Gener B. Amante sa konsepto ng isang linggong pagdiriwang (Marso 13-19) ay dumagsa na ang mga nag-aalok ng pakikiisa sa Todo Unlad: Malamig Festival.

BIÑAN SB FIASCO ON COLORUM, DELIBIRATE?
After my expose on this column on January 4, 2009 , on the existence of two versions of LTFRB Franchise to operate Biñan – Lawton via Expressway and vice versa route with the same case number 88-2195 I thought that the controversy would be soon over and will arrive at final resolution based on the face value of two documents.
True enough, the BTFRB of the Municipality of Biñan to which the alleged tampered version was submitted, in order to rectify things out wrote a letter to Sangguniang Bayan (SB) presiding officer Vice Mayor Walfredo Dimaguila with a recommendation that the Permit to Operate issued to JAC Liner earlier be revoked or cancelled for obvious reason that the documents (Case No. 88-2195) in their possession was quite different from the certified true copy from LTFRB.
True enough again, SB’s Committee on Transportation and Communication Chair Hon. Councilor JM Carait, on January 9 wrote JAC Liner to submit supporting documents within 15 days from receipt of the letter to justify said bus liner’s operation in Biñan. Verbally VM Demaguila and some honorable councilors said no franchise documents, no permit to operate for JAC Liner.
Quite true enough, the documents in possession of BTFRB is tampered when on January 23, 2009, JAC Liner presented to SB a franchise with LTFRB case number 88-2195 now in the name of Carlos Bautista and nowhere on said documents appear JAC Liner as originally submitted.
To give more weights to their argument JAC Liner also presented to SB a deed of absolute sale for 26 Units from the fleet of Laguna Express, Inc. including its franchise for only P5.2 Million. Same was filed allegedly with corresponding application to LTFRB. But nowhere will you see Laguna Express Inc. buses in Biñan yet JAC Liner continues to operate despite application pa lang ang naipa-file.
This twist of events lauded on the pages of Taliba, Police Files Tonight, Hataw on their February 6, 2009 issue and Manila Bulletin some days before.
But here’s the rub as the committee said that, “after CAREFUL EXAMINATION OF THE DOCUMENTS, EXHAUSTIVE DELIBERATIONS based on allegations and facts, the committee UNANIMOUSLY arrived on the following recommendations…, yet somewhere on its decision says that COMMITTEE ADMITTEDLY DID NOT LOOK into the INTRINSIC VALIDITY of the FRANCHISE in order to DETERMINE its AUTHENTICITY. (Eh, bakit pa po kayo nag-imbistiga?)
While a private party is clearly beyond doubt guilty of falsification of public documents it is sad to note that some of the honorable councilors of Biñan is equally liable for not scrutinizing the controversy for the real truth to come out. Some maybe are in cahoots for the commission of the offense. Those who erred must answer because the safety of Biñan commuters are at stake for there’s no safeguard whatsoever awaiting a passenger from “COLORUM” operator.
For this reason I’m referring this column to our friend at Public Assistance Bureau (PAB) of the Ombudsman who has proven many times as supportive as ever to Media’s investigative reporting. They investigate cases such as this against public officials even without formal complaint to determine the liabilities of said erring officials, through the concept that as media can only do little and PAB doing so much, together, the truth will always come out. SC LAUNCHES COURT-ANNEXED MEDIATION PROGRAM IN LAGUNA AND CAVITE
The Philippine Judicial Academy (PHILJA) under Supreme Court (SC) Chief Justice Reynato Puno launched last Friday Court-Annexed Mediation (CAM) program for the provinces of Laguna and Cavite during the Orientation Conference with stakeholders at Technopark Hotel here.
A full day briefing on CAM was moderated by Salvador C. Vilches, Mediation Supervisor of Philippine Mediation Center Office (PMCO), with an overview and Historical Background of Court-Annexed Mediation in the Philippines discussed by PHILJA Chief of Office for PMC Bernardo T. Ponferrada while the important roles of the court administrator, judges and court personnel in court-annexed mediation explained in detail by Supreme Court Administrator Jose P. Perez.
Those who attended were judges of: 27 Regional Trial Courts of the two provinces, 9 Municipal Trial Court in cities, 16 Municipal Trial Courts, 11 Municipal Circuit Trial Courts and their corresponding Clerks of Court. Also invited to attend the conference were prospective mediators from Integrated Bar of the Philippines, local government units, NGO’s and other stakeholders.
CAM is a process of settling disputes with the assistance of an acceptable, impartial and neutral third party called mediator who is acting as officer of the court in resolving disputes from which any agreement reach becomes the basis for the court decision on the case. The mediator will assist the court in decongesting court dockets, however if the mediation failed, any confidential information a documents obtained will not be used pro or against any party involve in the case.
All judges are required by SC to set aside cases subject for mediation before undergoing trial proper under the program.
The coverage of CAM includes all civil cases, settlement of estates and cases covered by the Rule on Summary Procedure, except those which by law may not be compromised; cases cognizable by the Lupong Tagapamayapa under Katarungang Pambarangay Law; Civil cases of Batas Pambansa Bldg. 22; civil aspect of quasi-offenses under Title 14 of the Revised Penal Code; civil aspect of estafa and libel cases where damages are sought and simple theft under Article 308, paragraph 3 to 8 of Revised Penal Code.
The program requires establishment of PMC units in Laguna and Cavite that will provide a system for the recruitment, screening, training and accreditation of Mediators. CAM started during the incumbency of former Chief Justice Hilarion Davide Jr. and was institutionalized by Chief Justice Reynato Puno.(NANI CORTEZ)

BLACK VALENTINES DAY PROTEST, ILULUNSAD
San Pablo City - Hindi kulay-pula ang puso ng tanggapan ng Pangalawang Punong Lunsod Martin A. Ilagan sapagkat wala itong pagmamahal sa mga maralita ng Barangay I-B at wala itong pakialam sa kahihinatnan ng mga bahay ng mamamayan kung tuluyan itong magigiba. Ganito ang buod ng salaysay ng Pangulo ng Buklod ng Pagkakaisa Neighborhood Association, Inc. at Kasapi ng Kalipunan ng mga Samahan sa Kanayunan ng Timog Katagalugan (KASAKA-TK).
Kaugnay nito ay isang Black Valentines Day protest ang kanilang inihahanda na suportado ng buong kasapian sangayon kay Tony Cerillo, pangulo ng Buklod.
Kung kaya sa ika-13 ng Pebrero sa panahon na ang pagbati ng mga pulitiko sa araw ng mga puso ay mamamayagpag ay sisimulan ng KASAKA-TK ang isang tuloy-tuloy na protesta, hanggang ang ordinansa para sa EXPROPRIATION PROCEEDINGS ay ganap na maging isang batas, ayon kay Jun C. Labro, taga pangulo ng nasabing samahan.
Dagdag pa ni Labro na ipinasa ng Sanggunian Barangay I-B, sa pamumuno ni Chairman Ricardo San Diego, ang resolusyong pipigil sa bantang demolisyon sa mahigit 400 kabahayan na kanyang nasasakupan. Ang Resolusyon Blg. 19, Serye No. 08 ng Sangguniang Barangay ay panimulang hakbang upang matulungan ang mga maralita. Magugunitang Nobyembre 14, 2008 ng tanggapin ng Bise-Alkalde ang naturang resolusyon ngunit Enero 22, 2009 lang nito konkretong binigyan pansin.

ANNUAL BUDGET HINDI PA RIN NAPAGTITIBAY NG SANGGUNIANG PANLUNSOD
Lunsod ng San Pablo - Bunsod ng mahabang panahong hindi pagkakaroon ng sesyon sa Sangguniang Panlunsd (SP), nabalam ng husto ang pag-apruba sa taunang budget ng lunsod na ito.
Noong Enero 19, 2009, ibinalik ng Sangguniang Panlunsod sa pamamagitan ng koreo ang labindalawang kopya ng General Fund Annual Budget for Calendar Year 2009 na nauna ng isinumite ng Tanggapan ng Punong Lunsod para mapagtalakayan at tuloy ay aprubahan.
Subalit hindi pa man lang ito natatalakay sa bulwagan ng Sanggunian, ibinalik na ito dahil sa diumanoy “bloated” at hindi sumusunod sa tagubilin ng Commission on Audit (COA).
Ayon kay City Administrator Loreto S. Amante, nagpahayag si Mayor Vicente B. Amante noong Enero 27 upang alamin kung ano ang problema sa proposed budget at ayaw itong aprubahan subalit wala umanong maiturong espesipikong problema si Vice Mayor Martin A. Ilagan maliban sa ito diumano ay “bloated”.
Sa isang press release na ipinalabas ni Arnold Acebron, Executive Secretary ni Vice Mayor Ilagan, sinasabi na “nagkaisa ang lahat ng mga pinuno ng tanggapan na dapat ay bawasan ang estimated revenues ng pamahalaang lokal upang makatugon sa tagubilin ng COA.” Mariin naman itong itinanggi ng mga department heads dahil ayon sa kanila, hindi sila tinanong tungkol dito.
Nakasaad din sa press release na ang “panukalang budget ay dapat naglalaman lamang ng mga tinatayang kita o estimated revenues na may kaseguruhan na makokolekta ng lunsod.
Kaugnay nito, sinabi ni Admin Amante na hiniling ng tanggapan ni Punong Lunsod kay Vice Mayor Ilagan na magkaroon ng isang marathon hearing upang mabigyan ng pagkakataon ang bawat isang department head na ma-justify ang kani-kanilang budget subalit walang marathon hearing na naganap.
Ayon naman kay Secretary to the Mayor Rudy Laroza, hindi dapat isalalay ang pag-apruba ng budget sa estimated revenues, gaya ng ikinakatwiran ni Ilagan dahil aniya, maging ang pamahalaang nasyunal ay nag-a-aprub ng budget base sa estimated revenues. “Wala namang problema doon. Kung hindi makolekta, eh, di pagkakasyahin ang kung anong nakolekta”, wika ni Laroza. “Ang mahalaga, hindi mababalam o mapaparalisa ang serbisyo publiko at mga programa ng pamahalaan”, dagdag pa nito.
Noong Biyernes, Pebrero 5, muling ibinalik ni Mayor Amante ang 2009 proposed budget sa Sangguniang Panlunsod bilang susog at aksyon na rin sa isang liham na ipinadala doon ng mga department heads na humihiling na madaliin ang pagpasa sa 2009 budget sa ngalan ng serbisyo publiko. Noong Enero 19, 2009, ibinalik ng Sangguniang Panlunsod sa pamamagitan ng koreo ang labindalawang kopya ng General Fund Annual Budget for Calendar Year 2009 na nauna ng isinumite ng Tanggapan ng Punong Lunsod para mapagtalakayan at tuloy ay aprubahan.
Subalit hindi pa man lang ito natatalakay sa bulwagan ng Sanggunian, ibinalik na ito dahil sa diumanoy “bloated” at hindi sumusunod sa tagubilin ng Commission on Audit (COA).
Ayon kay City Administrator Loreto S. Amante, nagpahayag si Mayor Vicente B. Amante noong Enero 27 upang alamin kung ano ang problema sa proposed budget at ayaw itong aprubahan subalit wala umanong maiturong espesipikong problema si Vice Mayor Martin A. Ilagan maliban sa ito diumano ay “bloated”.
